1. General Terms

By placing an order with Embroidery Factory LLC (“we,” “us,” or “our”), you acknowledge and agree to these Terms & Conditions. We reserve the right to update or modify these terms at any time. The version posted on our website at the time of your order will apply.

2. Quotes & Approvals

All quotes are valid for 30 days unless otherwise noted. Your order begins production only after:

  • Final artwork approval
  • Receipt of all garments and materials
  • Confirmation of order details
  • Payment or credit approval

Any changes made after approval may result in additional fees or production delays.

3. Turnaround Time

Standard production time is typically 7–10 business days after all requirements are met. Turnaround may vary based on order complexity, finishing services, artwork revisions, or garment availability.

Rush production is available on a limited basis and must be approved by our production team. Rush fees apply and cover production time only; shipping transit times are separate and not guaranteed.

We are not responsible for delays caused by:

  • Missing garments or incorrect shipments
  • Late approvals
  • Backordered items
  • Shipping carrier delays
  • Acts of God or circumstances beyond our control

4. Garment & Inventory Policy

We do not manufacture garments and cannot guarantee inventory levels. If an item becomes unavailable, we will suggest an alternative.

Customer-supplied items are decorated at the customer’s own risk. We are not responsible for manufacturer defects, dye migration, shrinkage, or damage to garments not purchased through us.

Customer-Supplied Goods Storage & Disposal Policy
Customer-Supplied Items
Any garments, products, or materials (“Customer Goods”) supplied by the customer for decoration, screen printing, or embroidery remain the property of the customer at all times.  Due to limited storage capacity and operational requirements, we will store Customer Goods for a maximum of ninety (90) days from the date the order is completed, cancelled, or placed on hold for any reason.

Abandoned Goods
If Customer Goods are not picked up or shipping arrangements are not completed within the 90-day storage period, the items will be considered abandoned.  At that point, we reserve the right, at our sole discretion, to:

  • Discard the items,
  • Donate the items,
  • Recycle or otherwise dispose of the items,
without any further notice or liability to the customer.

No Liability
We assume no responsibility or liability for Customer Goods after the 90-day period has elapsed. This includes, but is not limited to, loss, damage, or replacement value.  No refunds, credits, or compensation will be issued for abandoned or discarded Customer Goods.

If you are interested in storing Goods at our facility, please contact us for a custom storage quote. Storage services are subject to availability, written approval, and prepayment.

5. Artwork & Decoration Files

You agree that you own or have permission to use all artwork provided to us. We are not responsible for verifying ownership or licensing.

Digitized embroidery files, screen-printing separations, and production files created by us remain our property. Released files may incur additional fees.

Color matching is done as accurately as possible but may vary between screen displays, inks, threads, and fabrics.

6. Payment Terms

Payment is required before production or once production is completed, unless credit terms have been established. Orders placed under approved credit accounts must be paid according to agreed terms.

Late payments may result in:

  • Production delays
  • Suspension of credit
  • Additional fees

7. Cancellations & Changes

Orders cannot be canceled once garments have been ordered or production has begun. Changes requested after approval may result in additional charges or delays.

8. Spoilage & Allowance

While we make every effort to deliver perfect results, industry-standard spoilage rates apply:

  • Embroidery: up to 2%
  • Screen printing: up to 3%

Customer-supplied garments are decorated at 100% customer risk. We do not replace or reimburse spoiled customer-supplied items.

9. Shipping & Delivery

We ship via UPS Ground unless otherwise requested. Transit times are not guaranteed.

You may request to use your own shipping account; a handling fee may apply. We are not responsible for delays, lost packages, or damages caused by shipping carriers.

Local pickup is available at our Pittston, PA facility once you receive a “Ready for Pickup” notification.

10. Returns & Refunds

Decorated apparel is not returnable. If you believe there is an error with your order, you must contact us within 72 hours of delivery or pickup with photos and a written description.

We reserve the right to determine whether a remake, credit, or alternative resolution is appropriate.

11. Limitation of Liability

Our liability is limited to the amount paid for the order in question. We are not responsible for:

  • Customer errors in order details
  • Mistakes in supplied artwork
  • Variations inherent to decoration processes
  • Losses due to delayed orders or shipping issues

We are not liable for consequential, incidental, or indirect damages.

12. Customer Responsibilities

You agree to:

  • Provide accurate order details
  • Review proofs carefully before approval
  • Pick up orders promptly
  • Review goods upon receipt

Failure to follow these responsibilities may result in delays or additional fees.

13. Governing Law

These Terms & Conditions are governed by the laws of the Commonwealth of Pennsylvania. Any disputes must be resolved in a Pennsylvania court of competent jurisdiction.
